When To Interact With The Department Of Building And Safety?

When any government agency requests improvements for a dwelling or building, odds are that you will also need a permit from the Department Of Building And Safety to properly comply.

We have extensive experience identifying those items that will require a permit whether or not they were requested by a government agency and we will guide you through the process of acquiring the proper permits.

We also schedule and attend every required inspection until the permits are approved and closed.

There. How easy was that?

What the department is actually for

The building department exists to confirm that what gets built matches what was approved, and that what was approved meets the code. That is the whole function, and understanding it makes the process far less adversarial than it feels.

An inspector is not looking for reasons to fail you. An inspector is checking a list.

The sequence, which is where projects lose time

  1. Determine the jurisdiction. City or county, and it is not always the mailing address

  2. Confirm what the project requires: over the counter, express permit, or plan check

  3. Submit, with the drawings the counter actually asks for rather than what you assume

  4. Correction cycles, which are normal rather than a failure

  5. Permit issued

  6. Inspections at defined stages during construction

  7. Final inspection and sign-off, which is the document that matters years later

Most delay is in step three and step four, and most of that is avoidable by finding out what the submittal requires before assembling it.

Standard plans are the shortcut nobody uses

For common projects, many jurisdictions publish pre-approved standard plans. A project drawn to one of them skips full plan check entirely.

Patio covers, retaining walls up to a given height, and certain seismic retrofits all frequently have one. Asking whether a standard plan fits before paying for custom drawings is one of the highest-value questions in the whole process.

The final inspection is the part that outlives the project

Four different parties will eventually ask whether the work was permitted and finaled: an insurer at renewal, a lender on a refinance, a buyer's agent in escrow, and the department itself if anything else is ever done to the property.

An open permit that was never finaled is worse than no permit at all, because it is a record that work started and was never signed off. Closing permits is not administrative tidiness, it is the asset.

When the department writes to you

An order to comply is a warning with a date on it, and it escalates in one direction. The mandatory retrofit ordinances are the most common source of these letters in Los Angeles: earthquake retrofit in Los Angeles, and for apartment and condominium owners specifically: soft-story retrofit for property managers and HOA boards.

The worst response to a letter from a building department is silence. Almost every one of them has a path to resolution, and the paths get narrower with time.

Start with a free 15-minute call

Tell us the address, what you are planning or what letter you received, and whether the property is inside city limits. In fifteen minutes we can usually tell you which department you are dealing with, whether a standard plan fits, and what the submittal will want.
