Chimney Retrofit and Reconstruction in Los Angeles: What the Code Requires

On an older Los Angeles house, the chimney is usually the single most vulnerable thing on the property. It is unreinforced masonry, it is heavy, it is the tallest thing on the roof, and on houses built before the 1970s it is frequently tied to the structure by almost nothing.

That is why chimneys are the first thing to come down in a quake, and why the rules for putting one back are stricter than almost anyone expects.

The rule that surprises people: you usually cannot put it back the way it was

Homeowners assume a damaged brick chimney gets repointed and rebuilt in brick. In Los Angeles that is the exception, not the rule.

A damaged masonry chimney may be repaired with the same masonry construction only when the cost of the repair is less than ten percent of the cost of replacing the entire chimney, and the damage is confined to the upper half of the chimney or the upper two feet above the roof line, whichever is smaller.

Below that threshold you have a permit and no plan check. Above it, the position of the Department of Building and Safety is that the chimney cannot be reconstructed in masonry unless it is removed completely, redesigned and rebuilt to current code, which means structural plans and calculations stamped by a California-licensed civil engineer, structural engineer or architect.

So the practical fork is: a genuinely minor crack near the top, or a full reconstruction. There is very little in between.

The two standard-plan paths

LADBS publishes Standard Plan Bulletin SP-2, which sets out two pre-approved ways to reconstruct an earthquake-damaged chimney.

1. Removal and a factory-built metal chimney.

The unreinforced masonry is demolished down to the throat of the nearest undamaged firebox. A listed factory-built metal chimney, tested to Underwriters Laboratories Standard 103, goes in, enclosed in a steel stud chase framed with studs of at least 3-5/8 inches in 18 gauge. The height of the chimney above the roof is limited to ten feet. The firebox has to be inspected for cracks before anything is built on top of it.

This is the only method that can be permitted through the e-permit system, without a plan check appointment. For most houses it is the fastest compliant route.

2. A new masonry firebox with a factory-built metal chimney.

If the firebox itself is gone or unsound, or the owner wants masonry at the base, the firebox is rebuilt and the flue above it is factory-built metal. This one needs engineered plans, plan check in person at a Construction Services Center, and two sets of plans.

Any deviation from SP-2 at all sends the project into full plan check with stamped drawings. There is no informal version of this.

Why this is general contractor work, not chimney work

A chimney reconstruction touches more trades than the name suggests:

  • Demolition of masonry over a finished roof, without cracking the roof or the ceiling below it

  • Structural framing of the steel stud chase and its connection back to the house

  • A roof penetration, new flashing and a weather-tight tie-in to the existing roof

  • Exterior finish to match, whether that is stucco, siding or shingle

  • Interior drywall, firebox and hearth work

  • The permit, the inspections and the sign-off

That is a multi-trade, inspected structural job. It is the reason a Class B general building license exists, and the reason a chimney sweep or a masonry crew alone cannot close it out.

If your chimney is not damaged, it is still unreinforced masonry

Most of the chimneys we look at have not failed yet. They are simply old brick, stacked, with no reinforcing steel and no meaningful strap back into the framing.

That matters for two reasons. The first is obvious: it is a heavy object above a bedroom. The second is that a chimney that is not tied in is part of the same conversation as the rest of the structure.

If the house is on a raised foundation and has never been retrofitted, the chimney and the cripple walls are usually the same project. What actually drives the scope

Nobody can price this from a photograph, and anyone who does is guessing. What moves the work is:

  • How far down the damage goes, and whether the firebox survived

  • Height above the roof, which drives both the structure and the access

  • Roof type and pitch, because the demolition and the new flashing happen on top of it

  • Access for scaffold or a lift, which on a hillside lot can be the largest single factor

  • Whether the exterior finish has to be matched into existing stucco or siding

  • Whether the property sits in an HPOZ or has a historic designation, which changes what is allowed on the elevation

  • Whether the job can go through e-permit under SP-2 or needs engineered plans and plan check

Two houses on the same street can be very different projects. That is not a sales line, it is the reason we look before we quote.

The escrow angle

A cracked or separated chimney is one of the most reliably flagged items in a home inspection report. Buyers and their agents use it, insurers ask about it, and it is a common renegotiation lever late in escrow.

A permitted reconstruction with a final inspection card is the version of this that ends the conversation. An unpermitted repair is the version that reopens it at the worst possible time, because the next inspector will see brick that does not match and ask for the permit.

Common questions

Can I just have it repointed?

Only if the damage is genuinely minor by the code's own measure. Beyond that, repointing an unreinforced masonry chimney is cosmetic work on a structural problem, and it will not pass.

Do I have to have a fireplace at all?

No. Removing the chimney entirely and closing up the roof and the wall is a legitimate and frequently chosen option, particularly on a house where the fireplace is never used. It is also usually the simplest permit.

Will the new chimney look like the old one?

It can. A steel stud chase is finished to match the house, and on most elevations the result reads as the original. What it will not be is structural brick, because that is the part the code will not allow back.

Does it need a permit?

Yes, including the minor repairs under the ten percent threshold. The permit is what produces the record that an insurer or a buyer will ask for later.

What does it cost?
